What type of information we have:

We currently collect and process the following information:

  1. Personal identifiers, contacts and characteristics (for example, name and contact details)
  2. Such personal history and medical information as to your conditions, which either you or a member of your attending medical team provide us with.

 

How we get the information and why we have it:

Most of the personal information we process is provided to us directly by you for one of the following reasons:

 

  1. Because you wish us to consider your information in deciding what therapies we can offer;
  2. Because you wish to participate in our groups, or as a volunteer

 

We also receive personal information indirectly, from the following sources in the following scenarios:

 

Public domain knowledge, which we are free to share with others;

Under the Data Protection (Jersey) Law 2018, lawful bases we rely on for processing this information are:

  1. Your consent. You are able to remove your consent at any time. You can do this by contacting us: at the Jersey Oxygen Therapy Centre, Philip James House, Oak Tree Gardens, Trinity Hill, St. Helier, Jersey, JE2 4ZU. Please mark for the attention of the Data Protection Officer.
  2. We have a contractual obligation.
  3. We have a legal obligation.
  4. We have a vital interest.
  5. We need it to perform a public task.
  6. We have a legitimate interest.

What we do with the information we have:

We are required to assess each new client, and periodically re-assess clients if we become aware of any changes, against our laid-down protocols, overseen by our medical advisers.

We use the information that you have given us in order to:

Assess optimum therapies for which you may be eligible, and to decline to provide any such where it goes against our protocols, or medical advice;

We may share this information with:

  1. You and your attending medical team;
  2. Our internal team delivering therapies;
  3. Those with whom we have a legal obligation to share.

 

How we store your information

Your information is securely stored:

  1. in the duty senior operator’s card index, locked in the desk:
  2. Electronically in the practice management software we use;
  3. Initial consult reports are held in a locked filing cabinet to which the senior operator has access.

We keep all your data securely for one year after you cease to be a client, whereupon we will destroy same, or earlier if you so request.

 

Disposal of your information:

We will then dispose your information by:

  1. If held electronically, by double deletion;
  2. If physical, by secure destruction;

You have the right to specify how you would like your material disposed of.

Under the Data Protection (Jersey) Law 2018, you have rights summarised as including:

You have the right to ask us for copies of your personal information.

 

Your right to rectification:

You have the right to ask us to rectify information you think is inaccurate.

You also have the right to ask us to complete information you think is incomplete.

You have the right to ask us to erase your personal information in certain circumstances.

 

Your right to restriction of processing:

 You have the right to ask us to restrict the processing of your information in certain circumstances.

 

Your right to object to processing:

– You have the the right to object to the processing of your personal data in certain circumstances.

– You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.

 

Payment:

You are not required to pay any charge for exercising your rights.

 

Response:

If you make a request, we have four weeks to respond to you, or to explain why we need more time.
